购买拍卖房应该注意的问题


1、留意拍卖公告 竞买人如何参加房产拍卖交易?


　　拍卖对于普通百姓的确比较陌生，而参与其中并购买自己中意的物业也并不难。首先要留意各类拍卖公告。
　　如果有希望了解的物业可以与拍卖公司联系，到现场参观。由于物业价值比较贵，所需了解的事项又多，所以应该提前两周至一个月时间到现场考察，这样才有足够时间作出决定。如果决定参加竞标，需向拍卖公司交纳一定数量的保险金，约为1万元左右，然后凭有效证件做竞买登记。
　　
　　如果拍卖成交，应在一星期内交齐房款，拍卖委托主要在3个月内办理房产过户手续。拍卖成交的双方都要各自向拍卖公司交纳5%的佣金，过户时还要交纳0.75%的契税，也就是说有房价款5.75%左右的其他费用需要考虑。
　　
　　拍卖前的准备工作是拍卖成功与否的关键因素，主要工作就是调查房产的法律状况和根据自己的需求制定合理的竞买策略。
　　
　　被拍卖的物业是否有完备的法律手续是关系到拍卖成交后能否顺利过户，取得产权证的关键因素。拍卖公司会对拍卖房产进行法律状况的检查，但根据《拍卖法》的规定，拍卖公司不对所拍卖物品的真实性负责，也就是说一旦房屋出现法律纠纷，拍卖公司没有任何责任。所以竞买者如果拍卖的是待售商品房，一定要检查五证，如果拍卖的是业主出售的房产要检查产权证，以此保护自己的利益。
　　
　　另外，竞买人应该仔细考察物业本身及周边状况。很多人都希望通过拍卖买到一处比同类条件物业便宜的住宅，如果这样，一定要了解同一区域同一档次的其他物业的销售价格，将这个价格与拍卖底价比较，估算出还有多少价格上升空间，这时一定要记住还有近5.75%的佣金和契税。

2、房地产拍卖指南之委托人须知


　　为加强对房产拍卖管理，规范房地产拍卖行为，保护房产拍卖活动各方当事人的合法权益，根据《中国人民共和国城市房地产管理办法》和《中华人民共和国拍卖法》特制定下列拍卖须知：

一、委托人如何委托拍卖房地产

 1. 委托人必须是房屋所有权人、土地使用权人或依法可以处分房地产的公民、法人或其他组织；

 2. 委托拍卖的房地产必须具备转让条件；

 3. 委托人应持有转让房地产的有关证件；

 4. 委托人与拍卖人签定《委托拍卖合同》。

二、委托拍卖房地产应提供如下证件

 1. 房屋所有权证明；

 ① 房屋所有权证；

 ② 商品房销售专用发票、商品房销售合同；

 ③ 在建工程包括：

 ⑴ 计委批文；⑵ 建设用地规划许可证；⑶ 建设工程规划许可证；⑷ 商品房销售许可证；⑸ 施工图纸；⑹ 其他资料。

 2. 国有土地使用证；

 3. 有权处分房地产的文件，证明资料；

 ① 民事调解书、裁定书；

 ② 民事判决书；

 ③ 协助执行通知书；

 ④ 其他文件、证明资料。

 4. 房地产评估报告；

 5. 委托人的身份证明。


3、房地产拍卖之竞买人须知

竞买人如何竞买房地产

 2. 竞买人凭身份证明（身份证、营业执照副本）交付保证金，进行竞买登记并领取竞买号牌；

 3. 竞买人按拍卖公告指定的时间和地点参加拍卖会。拍卖时竞买人一旦举牌叫价或者应价，即表明竞买人已接受该拍卖房地产的一切状况，并不得撤回。当其他竞买人有更高叫价或者应价时，原竞买人的叫价或者应价即丧失约束力。
